Booking Terms and Conditions

By signing up to participate in our yoga Classes (“Classes”/” Class”), or visiting our studio, you agree to these Terms and Conditions and any other policies we publish or link to on our Website. These form an “Agreement” between you (“the Client”/ “you”/ “your”) and us, The Trustee for Tawa Yoga Trust [ABN 391 96 548 892] (“we”/ “us”/ “our”). If you do not agree with any of these terms and conditions, please do not participate in our Classes. 

1. MEDICAL WARNING

a) Undertaking Classes may have implications on your current medical conditions. We suggest that you consult with your medical practitioner prior to commencing attending Classes and that you are mindful of your current health concerns and physical limitations.

b) If you have any medical conditions including pre-existing injuries which may impact your ability to perform the movement in our Class, or if you are pregnant or ill you must notify your instructor prior to commencing the Class.  Participating in any form of exercise at our site with a Medical Condition is done entirely at your own risk.

c) It is your sole responsibility not to overexert yourself. Move at your own pace and stop immediately if you feel pain or discomfort. You should not continue moving if your physical condition changes at any time.

d) By undertaking any exercise program including Classes and use of any equipment purchased from us, you acknowledge that you do so at your own risk and that we will not be liable for any Loss or Damage arising from or as a result of, or in connection with your undertaking of any such exercise program or following advice contained on our Website or given by us. You likewise acknowledge that this equipment is for general use of all students.

e) Our Class instructors and staff are not medically trained and are not qualified to assess whether you are in good physical condition and/or whether you can engage in exercise without any detriment to your health, safety, comfort or medical conditions.

2. BOOKING AND FEES:

a) All Classes must be pre-booked online. Drop-ins may be accommodated if space permits; however, priority is given to students with pre-booked spots. Our Class fees and Class timetables are displayed on our Website. We reserve the right to change our fees and schedules from time to time, and these changes will be notified on our Website.

b) To sign up to participate in our Classes, you must create an account with us. You must maintain the confidentiality of your password and login. You are solely responsible for all use of your login and password.

c) There are a set number of spaces in each Class. To attend a Class, you must reserve a space by making the full payment. Class bookings can be made online up to 30 days in advance, and online bookings close 15 minutes before the Class starts. Students may still attend the Class by booking upon arrival if space is available; however, pre-booked students will receive priority.

d) Classes begin promptly, and studio doors are locked at the scheduled start time for security. Please arrive a minimum of 5 minutes before the start time to avoid disruption. Late arrivals will be unable to join, and the Cancellation Fee will be applied.

e) Family Accounts: Family accounts are an option available to assist families who have children aged 12-16yo that wish to attend Classes with the parent member or pass holder. A child aged 12-16yo may be added to your account without requiring a separate account set up for them.  The child aged 12-16yo may only attend Class when accompanied by you as the supervising adult.  This applies solely to regular, non-heated and non-yin scheduled Classes. As the accompanying adult, you are responsible for the child at all times, including signing any necessary waivers for their participation. If the child disrupts the Class, you may be asked to remove them.

i.  Family accounts are only available for Memberships and numbered Class passes and do not apply to the Welcome Pass, Upgrade to Welcome Pass or any other specialty pass or event pass.

ii.  For Unlimited memberships one child can attend Class with you for free.

iii.  For Monthly memberships and numbered Class passes your Class credits can be shared with your child. Each adult and child attendance will use a Class credit each.

iv.  For Family Yoga Class only one booking/credit in the adult member /pass holders name is required.

v.  When your child is no longer 16yo they will require their own account and their own Class pass or membership.

vi.  Family Accounts are not applicable for the Welcome Pass or Upgrade to Welcome Pass. A child aged 16 or younger may be added to your account without requiring a separate account or pass for them. Only one (1) child aged 12-16 may attend Class when accompanied by you as the supervising adult. This applies solely to regular, non-heated, and non-Yin scheduled Classes.

vii. As the accompanying adult, you are responsible for the child at all times, including signing any necessary waivers for their participation. If the child disrupts the Class, you may be asked to remove them.  For numbered Class passes, or numbered Class memberships, when booking, your Class credits can be shared with a child. Each adult and child attending together will use one Class credit per individual and children over 16 can continue using Class credits through the Family Account setup.

viii. For Family Yoga and Unlimited Membership, a separate booking for the child is not required; your booking covers both you and the child. Only one child may attend with you per Class session. 

ix. Family Accounts and Unlimited Membership do not apply to children over 16, who must have their own account and pass.

f) Pass Activation and validity:

We offer memberships, casual and numbered Class passes. All Memberships are on autorenewal activate from the date of purchase. Annual Memberships active from the date of purchase. All casual and numbered Class passes activate from the date of purchase. Where you purchase a welcome pass, it must be activated within 90 days from the date of purchase. Where you upgrade from a Welcome pass it will activate from the date of purchase. All Class series passes activate from the first Class in the series.

Where you purchase an unlimited membership, the direct debit will auto renew and is valid for the 14-day billing period. All base Memberships auto renew and are valid for 5 Classes for each billing month. Annual memberships are valid for 12 months from the activation date. Single casual Class passes and 5 Class passes must be used within 1 month of the activation date. 10 or more numbered Class passes must be used within 12 months of the activation date. Any welcome pass is valid for 21 consecutive days from the first booked Class. Any upgrade from/to a welcome pass is valid to use over 20 consecutive days from the purchase date.

Any pass periods or Classes not used within the validity period above, are forfeited and do not roll over into a new pass or membership.

3. PERSONAL INFORMATION:

a) When you create an account, you agree to provide us with your personal information including but not limited to your name, age, medical or health conditions related information and any other information as required (“information”). You represent and warrant that:

i. all information you provide is true, correct, current and up to date; and

ii. you will respond promptly to any of our requests for further information.

b) Your personal information collected by us will be dealt with in accordance with our Privacy Policy, a copy of which can be viewed in full here.

4. PAYMENTS AND DIRECT DEBIT:

a) Our Class Fees are payable prior to the Class and at the time of booking. Except as required by the Australian Consumer Law, no refunds are provided. If you wish to credit your Class Fee to a later Class, please notify us at smile@regspiritualpractice.top. All credits for other Classes are given at our sole discretion.

b) Direct debits will be taken out of your account every 14 days for fortnightly Memberships and each calendar month for Monthly Memberships. You must have sufficient funds in your account to cover membership and cancellation fees.  You accept responsibility for any and all fees incurred should your direct debit fail, or fees need to be recovered.

c) Special events, Class series, workshops, youth yoga and private events and workshops are not included in the membership.

5. CLASS WAITLISTS:

You can register yourself on the Class waitlist If you are unable to book a spot because the Class is full.  Joining a waitlist does not guarantee a spot. Please ensure you check your email for your waitlist confirmation. When a spot becomes available, all waitlisted students will be notified by email. The first student to respond and confirm acceptance will secure the spot.

6. CLASS SCHEDULES AND OPENING HOURS:

We reserve the right to cancel or change Classes, teachers, events, and workshops. If a booking is affected, you will be notified in writing. We are not liable in any way to provide you with a refund, credit, transfer or compensation of any kind for Classes that are not held in accordance with the Class schedule.

7. CANCELLATION POLICY:

We reserve the right to cancel or change Classes, teachers, events, and workshops. If a booking is affected, you will be notified in writing. a) Class bookings must be cancelled through the online booking system by logging into your account and selecting the cancel option.

b) You must cancel your booking at least 6 hours prior to the Class start time to avoid a late cancellation penalty. Cancellations made less than 6 hours will incur a $10 cancellation fee for Memberships and the Welcome Pass or the pass forfeited for casual or numbered class passes for general scheduled Classes. For events, workshops, Class series, or private bookings, cancellations must be made at least 48 hours in advance, or the pass will be forfeited. No makeup Classes are offered for missed sessions.

c) If you attempt to cancel within the 6-hour window, you will be notified of the late cancellation at the time of attempting to cancel.

d) In the event of extenuating circumstances (e.g., an emergency), if you call, text, or email us, we may waive the late cancellation fee at our discretion.

e) For no-shows:

i. Students with unlimited passes or memberships will be charged a $10 fee for missing a Class without cancellation.

ii. For casual or numbered Class passes, events, workshops, Class series, or private bookings, no-shows will result in forfeiting the specific pass.

8. MEMBERSHIP CANCELLATIONS AND PAUSES:

a) You can cancel any membership with 30 days prior written notice to Tawa Yoga by email to smile@regspiritualpractice.top. The 30 days written notice is additional to and must not include any FREE or PAUSE periods of your membership.

b) At the time of receipt of your cancellation email, all direct debits that would fall due up to the date of the cancellation period will be deducted upfront.

c) You may pause an unlimited or monthly membership with 14 days written notice by email to smile@regspiritualpractice.top. Each pause must be a minimum of 7 days and a maximum of 2 months. An administration fee of $10 per 7-day period or part thereof will apply and is deducted upfront upon notice received. At the end of the pause period requested your membership will automatically renew. Any pause periods will not be included in a cancelation written notice period. You cannot pause an Annual Membership.

d) We reserve our right to pause or terminate your pass or membership to: protect the health and safety of you or other members; or the temporary or permanent closure of the studio; or if it reasonably believes you have engaged in inappropriate conduct.

9. CONDUCT RULES AND YOUR OBLIGATIONS:

a) You are required to treat all persons and property in the Class with all due care and respect. We reserve the right to refuse entry to or remove you from our site for breaching our Conduct Rules including any anti-social, intoxicated, disorderly, aggressive, offensive, inappropriate, discriminatory or dangerous behaviour that may threaten the safety or security of our clients, staff, any other persons, including infrastructure and equipment.

b) If you consider that someone is breaching the Conduct Rules, please notify our staff so that we can address the issue immediately.

10. PHYSICAL TOUCH

You acknowledge and agree that:  our instructors may use tactile cueing and adjustment methods or make physical contact with you for correction purposes in order to ensure that attending yoga Classes in person is undertaken in accordance with Tawa Yoga’s best practice. If you do not wish to be touched, please notify us prior to any Classes. We will ask for your verbal consent at each instance where physical touch may be required.

11. PREGNANCY AND OTHER CONDITIONS

a) We offer specific Prenatal Yoga and Postnatal Yoga Class series, as well as a Beginners’ 6-Week Series, all governed by a specialty course series pass, which can be found on our Website. Teachers for these Classes hold specialised qualifications in pre/postnatal yoga to ensure the safety and well-being of both mother and baby.

b) While we recommend our prenatal series for expectant mothers, students may also attend regular Classes during pregnancy. We advise pregnant students, particularly in the first trimester, to prioritise rest and self-care. During this time, we encourage attending restful Classes such as Restorative or Yin Yoga, and students will be informed of the necessary posture modifications to accommodate the baby.

c) Second Trimester: If the student has the capacity and interest, they may explore a broader Class range, with modified guidance provided for safe practice during this period.

d) Third Trimester: We recommend returning the focus to restful and restorative practices as the pregnancy progresses.

e) For students who become pregnant during their membership, many opt to reduce their practice to restorative Classes while also attending the Prenatal Yoga Series. Additionally, many of our prenatal students are new to yoga and join the series for a gentle introduction to yoga during pregnancy

12. PERSONAL BELONGINGS

We do not assume any responsibility to safeguard your personal belongings that you bring into our site. As such, we strongly recommend that you:

a) refrain from bringing any valuable personal belongings into our site such as mobile phones, jewellery, personal devices, wallets, handbags and purses;

b) only bring personal belongings onto our site that are absolutely necessary for you to possess for the duration of your visit; and

c) store any personal belongings in the storage facilities provided for use for the duration of your visit.

13. AUSTRALIAN CONSUMER LAW

a) Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

     i. to cancel your service contract with us; and

    ii. to a refund for the unused portion, or to compensation for its reduced value.

b) You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

14. LIMITATION OF LIABILITY

a) To the maximum extent permitted by law, we are not liable for any Loss or Damage arising from your attendance at our site or Classes including, but not limited to, any theft, unauthorised access or third-party interference.

b) To the extent to which we are entitled to do so, our liability under the Australian Consumer Law will be limited, at our option to:

     i. the supply of equivalent services e.g., another opportunity to book a Class; or

    ii. the refund of the payment made for the Class.

c) In any case, our liability to you will not exceed the amount actually paid by you to us for the Class. You acknowledge, agree and undertake to indemnify us and keep us at all times fully indemnified from and against any claims whatsoever arising directly or indirectly as a result of any breach by you of this Agreement, any conduct by you in participating in our Classes, and any third-party claims.

15. TERMINATION AND REFUNDS

We may, at our sole discretion and without prejudice to any of our rights, immediately terminate this Agreement where you breach any term or condition of this Agreement. If you are in breach of this Agreement, you will not be entitled to any refunds including any refunds of any Class Packs, and any outstanding Fees become immediately due and payable.

16. FORCE MAJEURE

Where there is a Force Majeure Event, we will not be considered in breach of this Agreement, to the extent that our obligations are unable to be performed by such an event. We will not incur any liability to you for any Loss or Damage of any nature incurred or suffered in connection with any Force Majeure Event.

17. IF THERE IS A DISPUTE

You acknowledge and agree that confidentiality is paramount to our reputation. At no time will any communications or discussions be made public, including but not limited to any social media Websites. Any public discussion or comments considered defamatory, negative or otherwise damaging will be the subject of compensation in any mediation or litigation claim. In the event of any dispute that cannot be resolved by mutual agreement, both parties agree to obtain an independent professional arbitrator/dispute resolution specialist to make a determination on the dispute and each party agrees to pay their own costs.

18. GOVERNING LAW AND OTHER MATTERS

This Agreement is to be construed in accordance with the laws of QLD, Australia, and you and we submit to the jurisdiction of the courts of QLD, Australia. This is the entire Agreement between you and us and supersedes any prior agreements, proposals and communications whether oral or written, between you and us. In the event of an inconsistency between this Agreement and other terms and conditions on our Website, these Terms and Conditions will prevail. No other term is to be included in this Agreement except where it is required to be included by law. The failure by us to exercise any right or enforce any provision in these Terms and Conditions does not waive the future operation of that right or provision. In the event that a provision in this Agreement is not enforceable, such provision shall be severed from this Agreement to the extent permitted by law, and the remaining provisions will remain in full force and effect. All obligations and liabilities in this Agreement will survive termination of this Agreement.

19. DEFINITIONS

“Agreement” means these Terms and Conditions, our Website Terms of Use, Privacy Policy and any other policies we publish or link to on our Website.

“Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth). 

“Claims” mean any claim, under the statute, tort, contract or negligence, any demand, award or costs.

“”Class” means attending yoga Classes in person conducted at our site.

“Fees” mean payment due from you for the Classes provided by us. 

“Force Majeure Event” means any event beyond our control which prevents us from complying with our obligations under this Agreement, including but not limited to, a pandemic, act of God, such as fires, earthquakes, floods; war or hostilities, riots, strikes, disorder or acts or threats of terrorism, or electrical failure, changes to regulations, weather events, travel limitations, venue closures.

“Loss or Damage” means any direct, indirect, incidental, punitive, special, or consequential loss or damages of any kind, including but not limited to, any loss of profits, revenue, savings, loss of enjoyment, loss of opportunity, loss of reputation or goodwill, loss or corruption of information or data, personal injury, death, property damage and legal costs.

“Medical Condition” means any type of illness, disease, injury, condition, disability, disorder, physical deformity or mental illness.

“Site” means the physical location(s) where the Classes are held.

“We, us, or our” means The Trustee for Tawa Yoga Trust [ABN 391 96 548 892] and includes any of our directors, officers, employees, agents, partners and contractors.

“Website and Services” means regspiritualpractice.top and everything available on this Website including, but not limited to, products and services.
